By accessing this Site or any of the services provided to you through this Site, you acknowledge that you have read, understood, and agreed to be bound by the Terms, which include the Shoulderpod Privacy Policy (available at http://www.shoulderpod.com/privacy). If you are not eligible or do not agree to these Terms, then you should not access the Site. Shoulderpod or its legal representatives will take all necessary measures within their power to prevent any conduct that is contrary to Spanish Laws, and will cooperate with the relevant authorities in the identification of persons responsible for actions that may constitute violations of the laws or the conditions applicable to this website.

2. Eligibility

This Site is addressed to E.U. customers. In order to access the Site, you must be at least 16 years of age and in compliance with all applicable laws and regulations. Furthermore, if you are accessing the Site on behalf of an entity, organization, or company, you must represent and warrant that you have the authority to bind that organization to these Terms, and accept these Terms on their behalf. By agreeing to these Terms, you are confirming that you have fulfilled these requirements.

3. Accounts and registration

In order to access certain features of the Site, you may be required to register for a Shoulderpod account. When doing so, you will be asked to provide us with some information about yourself, such as your email address or other contact information. It is important to ensure that this information is accurate and up-to-date at all times. Additionally, you might be asked to provide a password for your account. You must maintain the confidentiality of your account and password, and you accept responsibility for all activities that occur under your Shoulderpod account.

4. Prices

All prices of our products are in EUR and are indicated on our website when placing your order. We reserve the right to modify the prices at any time. The new prices shall be immediately applicable to new orders and to any modifications you make to previous orders. However, orders that have already been made and are in the process of being delivered will not be subject to any price changes.

5. Payments

Payment must be made in EUR prior to dispatching the goods through our online store checkout . We accept payments via Credit Card or PayPal with no commission applied. In case you would like to pay by Bank Transfer, please contact us by email so we can send you a formal Quote with all the details.

Your payment details, such as credit card numbers, bank accounts, and PayPal passwords, are managed directly by our payment partners, Stripe and PayPal, and are strictly protected by secure industry standards. Shoulderpod does not have direct or indirect access to any of your confidential financial information.

6. Product availability

At Shoulderpod, we make every effort to ensure the availability of our products for purchase. However, we cannot always guarantee that a product you wish to buy will be in stock at the time you place your order. If the product you have requested is unavailable, we will contact you promptly to advise of the situation. Your order will then be either refunded or postponed depending on your preference.

7. Invoicing

If you are ordering from a E.U. registered company with a valid VIES number, please make sure you provide us with all your company details when placing your order so we can issue you a Commercial Invoice.

8. Delivery

In order to offer you the best price-quality service, we deliver orders using different premier couriers and postal services.

  • Delivery costs are calculated and displayed at checkout and may depend on the volume, weight, and destination of the goods ordered.

  • Some regions of the EU may be excluded from our scope of delivery due to their specific taxing or geographic circumstances.

  • Delivery usually takes between 3 to 6 working days, but can take longer depending on the destination, the time of the year or any other unusual situation.

  • If you think your order is delayed, please get in touch with us immediately so that we can take appropriate action with our delivery partners. Please note that not informing us of a delay may lead to the courier or postal service returning the order back to our office in Barcelona.

9. Returns and refunds

At Shoulderpod, we want all of our customers to be fully satisfied with their purchase. If for any reason you are not satisfied with any of the products you have received, you may return them within 14 days of the original purchase date according to the instructions and conditions of our Returns Page (http://www.shoulderpod.com/returns)

10. Shoulderpod products guarantee

At Shoulderpod, we carefully design and craft all our products. However, we understand that things are not always perfect. If you have any concerns about the quality of a product you have purchased, please contact us here and we will be pleased to help you as soon as possible.

  • All Shoulderpod products are guaranteed against manufacturing defects for a period of two (2) years from the date of purchase.

  • Please keep a copy of your receipt as proof of purchase.

  • Should the product malfunction or break due to a manufacturing defect, Shoulderpod will repair it, replace it, or refund the purchase price at its own discretion.

  • This guarantee excludes damages resulting from improper use, accidents, modifications, normal wear and tear, or any other causes that are not manufacturing defects.

  • This guarantee does not affect any other statutory rights the Purchaser might have.

11. Third party brands guarantee

All products from third party brands ordered on the Site will be covered by the manufacturer’s Guarantee. Please keep a copy of your receipt as proof of purchase and feel free to contact us in case you need any additional information with regards to third party brands guarantees and repairs.

12. Privacy policy

Please read the Shoulderpod Privacy Policy (http://www.shoulderpod.com/privacy) carefully in order to understand our collection, use, storage and disclosure of your personal information. This Policy is incorporated into these Terms and is an integral part of them.

13. Using the site

By entering into these Terms and using the Site, you represent and warrant that your use of the Site complies with and will continue to comply with all applicable laws, statutes, and regulations. Any use of the Site that does not adhere to these Terms is strictly prohibited.

By using the Site, you agree to not access the Site for any illegal purpose or in violation of any local, state, national, or international law. You also agree not to conduct activities that may be harmful to others or that could damage Shoulderpod's reputation, or to violate, or encourage others to violate, any right of a third party, including by infringing or misappropriating any third party intellectual property right or violating any third party's right to privacy.

14. Discontinuation and modification of the site

If you violate these terms, your permission to access the site will be permanently revoked. Shoulderpod reserves the right to terminate or suspend your account or access to the Site at any time, with or without notice, and for any reason or no reason. We also reserve the right to modify or discontinue the Site or any features of the Site at any time, temporarily or permanently. In the event of any termination or suspension, you will not have access to any data or content posted to the Site and we will not be liable to provide you with access to such data or content. Shoulderpod is a registered trademark of Shoulderpod SL, from Barcelona, Spain. All designs are registered and are protected under the international copyright and intellectual property treaties. All images, graphics and text appearing in the site(s) are the exclusive property of Shoulderpod SL or of their respective owners and are protected under international copyright treaties. All images, graphics or texts may not be copied, reproduced, redistributed, manipulated, projected, used or altered in any way without the prior express written permission of Shoulderpod SL. or their respective owners.

16. About third party brands

Shoulderpod is not directly or indirectly associated with any of the third party brands shown on this website, nor do any of these brands endorse us. The brands and products from third parties mentioned or shown in images or videos on this website are merely to illustrate or demonstrate potential uses of the Shoulderpod products. All trademarks and copyrights remain the property of their respective owners.

17. Modification of these terms

We reserve the right to modify these Terms, at our discretion, on a going-forward basis at any time. We recommend that you check these Terms periodically for any changes. Any modified Terms will take effect immediately upon publication. We will make every effort to provide you with reasonable notice before any material changes become effective. If you continue to access the Site, you agree to be bound by the updated, amended, or modified Terms. If you do not accept the modified Terms, you must immediately cease your access to or use of the Site. Any disputes arising from these Terms will be resolved in accordance with the version of these Terms that was in effect at the time the dispute arose.

Shoulderpod does not guarantee that the Site, any portion of the Site, any materials, or User Content offered through the Site, will be uninterrupted, secure, free from errors, viruses, or other harmful components. Should any such issues arise, we do not guarantee that they will be corrected.

By accessing this Site you agree to use it at your own discretion and risk. You assume all risk and responsibility for any damage that may result from your use or access of the Site, as well as any materials or user content available through the Site. You understand and accept that you are solely responsible for any injury, death, damage to your property or third party property, or the loss of data that results from your use of the Site or your inability to use it.

Purchaser assumes all liability, and as such releases Shoulderpod S.L. from any liability for any accident, injury, damage, death, loss, illegal activity or any other claim that may occur resulting from or during use of the Product, whether or not such use is foreseeable by Shoulderpod S.L.

To the extent not prohibited by law, in no event will Shoulderpod S.L. be liable for any lost data, revenue or profit, or for special, indirect, consequential, incidental or punitive damages, however caused arising out of or related to the use of or inability to use the product, even is Shoulderpod S.L. has been advised of the possibility of such damages.

UNDER NO CIRCUMSTANCES WILL SHOULDERPOD’S LIABILITY EXCEED THE AMOUNT PAID BY PURCHASER FOR THE PRODUCT.

19. Governing law

These Terms and Conditions of Sale are governed by the laws of Spain. This agreement shall be deemed to have been executed in the jurisdiction in which you reside, and the courts and tribunals thereof shall have the jurisdiction to resolve any dispute that may arise in relation to these Terms and Conditions of Sale.

You agree to submit to the non-exclusive jurisdiction of the Spanish Courts, giving you the option to bring a claim to enforce your consumer protection rights in connection with these Terms in a court located in Spain or in the EU country in which you reside. Shoulderpod reserves the right to bring claims against you before the courts of Spain or before the courts of the EU country in which you reside, should you be a consumer.
